ANTHAVI PILOT TERMS OF USE
Version 1.3 · Last updated: October 10, 2026 · Pilot text, under legal review
Limited Real-Family Pilot | Version 1.3
Nexaverse Group, Inc. | Anthavi
1. Scope and Pilot Status
These Terms govern participation in the limited Anthavi real-family pilot operated by Nexaverse Group, Inc. Anthavi is a developing service and may contain errors, interruptions, incomplete features, or changes. The pilot is not a finished commercial service and should not be used as the only copy of irreplaceable family materials. By creating or using an Anthavi account, accepting an invitation, contributing content, or selecting “I Agree and Continue,” you agree to these Terms and the applicable Anthavi Privacy Policy, Contribution Guidelines, Contributor Acknowledgment, and any role-specific consent presented to you.
2. Eligibility and Accounts
Direct participant and contributor accounts are for adults age 18 or older. Users must provide reasonably accurate account/invitation information, protect their credentials, and use Anthavi only for lawful and authorized memorial/storytelling purposes.
3. Family Memorial Case and Roles
A Designated Family Representative coordinates the family memorial experience and makes the family-level choices available in the pilot. Contributors retain rights in content they own. A funeral home may facilitate the workflow but does not thereby own family content or become the legal representative of every participant.
4. User Content and Ownership
Users retain ownership of User Content they own. By contributing content, a user grants Nexaverse the limited rights reasonably necessary to host, process, organize, display, reproduce, transform for technical delivery, and otherwise use eligible content to operate the authorized Anthavi memorial experience, subject to these Terms, applicable policies, contributor permissions, family-level choices, and specialized consents.
5. Contributor Authorization
An adult contributor agrees once when joining and beginning to contribute that eligible material voluntarily added to the private memorial workspace may be considered for use in the Tribute and, if the family selects it, the Living Story. The pilot does not offer separate memory-by-memory Tribute/Living Story use or audience controls. Uploading alone does not make content public.
6. Family-Level Tribute and Living Story Decisions
A Tribute review/approval may occur when arranged by the participating funeral home or Nexaverse. The Living Story is created only if the Designated Family Representative affirmatively selects it and chooses its visibility. The Living Story is designed to evolve as eligible contributions are added and does not require repeated final approval after each update.
7. Visibility and Sharing
Living Story visibility is selected at the family level: Family Only, Anyone with the Approved Link/QR, or Public by explicit opt-in where permitted. A QR code or link does not by itself make a Living Story public. Family-level choices do not transfer ownership or authorize materially different uses that require separate permission.
8. Content Rules
Users must follow the Anthavi Contribution Guidelines & Acceptable Use and User Content, Copyright & Media Policy. Nexaverse may restrict, hide, block, or remove affected shared content when reasonably necessary to address safety, rights, security, policy, or legal concerns.
9. Privacy
Anthavi’s handling of personal information during the pilot is described in the Pilot Privacy Policy and Family Pilot Consent & Authorization. More specific restrictions and specialized consents control where they provide narrower permission.
10. Facial Recognition, Biometrics, and Specialized Uses
General acceptance of these Terms does not authorize facial recognition, face matching/clustering, biometric processing, synthetic/cloned voice, avatars or digital replicas, conversational memorial agents, general AI/model training, marketing, publicity, or academic research. Facial recognition or related biometric processing runs only after the required separate affirmative consent, the Facial Recognition & Biometric Consent, has been given. Other materially different specialized uses require their own applicable authorization or consent.
11. Multiple Perspectives, Accuracy, and Family Disagreements
Family members may remember events differently. User Content reflects the recollections, interpretations, statements, or materials of the applicable contributor. Nexaverse does not certify which good-faith family recollection is historically correct. When a credible dispute arises, Nexaverse may temporarily restrict, hide, unpublish, freeze, or limit affected content or access while preserving relevant records and reviewing the concern.
12. Funeral-Home Role and Access
A participating funeral home may have access reasonably necessary to facilitate an active memorial workflow. The funeral home should not adjudicate complex family, copyright, privacy, ownership, consent, or authority disputes. Funeral-home access may be narrowed or ended when roles change, the organizational relationship ends, or Nexaverse determines restriction is reasonably necessary. Case closure may trigger a manual access review; Anthavi does not promise automatic access termination at case closure.
13. Living Story: Complimentary Editing and Ongoing Access
The family-selected Living Story and its authorized QR/link will remain hosted and viewable indefinitely at no charge, subject to these Terms, applicable policies, lawful requests, technical/service changes, and the limits stated below. The family receives twelve (12) months of complimentary editing access following the memorial service. After that period, the Living Story and existing authorized QR/link remain hosted and viewable in read-only form at no charge unless the family requests an eligible deletion/change or another applicable policy requires a change. A paid subscription is not required to maintain read-only access.
14. Download, Retention, and No Automatic Archive
The Designated Family Representative may request or access, where technically available, a downloadable copy or export of supported memorial content at any time. An export may not reproduce every interactive, proprietary, licensed, third-party, or platform-dependent feature; licensed commercial music may be excluded, muted, replaced, or unavailable when the applicable rights do not authorize redistribution. Nexaverse does not automatically archive or delete the Living Story merely because complimentary editing ends or the account becomes inactive. If a future abandoned-account or similar policy materially affects an existing Living Story, appropriate notice will be provided.
15. Optional Continuation into WeTales
After the memorial service, eligible Anthavi content may be offered for optional continuation in WeTales. No paid WeTales upgrade is required to complete the pilot, there is no automatic free-to-paid conversion, and any later paid service or editing reactivation requires separate affirmative acceptance or purchase. Moving eligible content into WeTales does not automatically make it public or broaden existing contributor or specialized-consent restrictions.
16. Music and Other Third-Party Media
Music, photographs, video, recordings, artwork, documents, and other third-party media may be used only when applicable rights or authorization permit the selected use. Availability online or through a consumer subscription does not itself authorize copying, synchronization with a memorial video, public performance, publication, download, redistribution, or perpetual use.
17. Reporting, Restriction, Removal, and Deletion
Participants may request review, restriction, removal from shared display, correction, export, or eligible deletion through the available support process. These actions can have different effects. Content incorporated into completed/delivered materials or downloaded copies may not be retractable from every copy. A family member does not automatically have authority to delete another contributor’s independently controlled content. Backup, security, fraud-prevention, or legally required records may have separate retention rules.
18. Copyright and Intellectual Property
Nexaverse and its licensors own Anthavi’s software, branding, designs, interface, documentation, and other platform materials, excluding User Content and third-party materials.
These Terms do not give users ownership of Nexaverse technology or intellectual property.
Nexaverse may maintain procedures for copyright complaints, media concerns, and content-removal requests. A separate User Content, Copyright & Media Policy may provide additional details. Nexaverse may restrict allegedly infringing material while a complaint is reviewed.
19. Service Availability and Changes
Anthavi may change features during the pilot. Nexaverse may suspend or limit features or access when reasonably necessary for maintenance, security, legal compliance, safety, rights protection, or pilot operations. Material changes affecting participant rights, privacy, permissions, existing content, or memorial access will be communicated appropriately.
20. No Guarantee of Permanent Uninterrupted Service
The lifecycle described in these Terms is the current pilot commitment, but Nexaverse cannot guarantee uninterrupted or technically permanent availability of any internet service, QR destination, vendor, feature, or storage system. Any future policy or service change materially affecting an existing Living Story will be handled consistently with applicable law, these Terms, and appropriate notice.
21. Feedback
Participants may provide voluntary product feedback. Ordinary pilot feedback does not by itself authorize Nexaverse to use identifiable family content, names, images, testimonials, or stories for marketing, publicity, academic research, or general AI training. Those uses require separate appropriate permission where applicable.
22. Security and Acceptable Use
Users must not attempt to bypass access controls, probe or attack systems, introduce malware, scrape private content, impersonate others, or interfere with Anthavi. Suspected security incidents or unauthorized access should be reported promptly.
You may not:
access an account, case, collection, or data without authorization;
interfere with the security, integrity, availability, or operation of Anthavi;
scrape, harvest, probe, reverse engineer, or misuse the pilot except as permitted by law or written authorization;
use Anthavi for fraud, deceptive impersonation, harassment, unlawful surveillance, infringement, or other unlawful conduct;
circumvent privacy, sharing, access, or security controls;
use another contributor’s content beyond the permissions granted; or
attempt to activate or use disabled AI/biometric/digital-replica functionality outside an approved pilot workflow.
23. Suspension and Termination
Nexaverse may suspend or terminate access when reasonably necessary to address serious policy violations, security concerns, unlawful activity, credible rights disputes, misuse, or material risk. Where practical, Nexaverse will use proportionate restrictions and preserve relevant records needed to review a dispute or comply with law.
24. Emotional-Safety and Professional-Service Disclaimer
Anthavi may contain content concerning death, grief, illness, trauma, family conflict, violence, or other emotionally sensitive experiences. Viewing, hearing, creating, or sharing memorial content may cause sadness, distress, disagreement, or other emotional responses.
Anthavi provides memorial storytelling, preservation, and related technology. It is not psychotherapy, grief counseling, mental-health treatment, medical care, legal advice, estate advice, or historical certification.
If participation becomes distressing, confusing, or burdensome, a family or contributor may pause participation and use the available support process.
25. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANTHAVI IS PROVIDED DURING THE PILOT ON AN “AS IS” AND “AS AVAILABLE” BASIS.
NEXAVERSE DOES NOT WARRANT THAT THE PILOT WILL BE UNINTERRUPTED, ERROR-FREE, SECURE AGAINST EVERY POSSIBLE THREAT, OR THAT EVERY FEATURE, QR/LINK DESTINATION, THIRD-PARTY SERVICE, LICENSED MEDIA ITEM, AI-ASSISTED OUTPUT, OR EXPORT WILL ALWAYS BE AVAILABLE OR ACCURATE.
TO THE EXTENT PERMITTED BY LAW, NEXAVERSE DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NOTHING IN THESE TERMS EXCLUDES A WARRANTY, RIGHT, REMEDY, OR RESPONSIBILITY THAT APPLICABLE LAW DOES NOT PERMIT TO BE EXCLUDED.
26. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEXAVERSE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO THE PILOT, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION.
EXCEPT FOR LIABILITY THAT APPLICABLE LAW DOES NOT PERMIT TO BE LIMITED, NEXAVERSE’S AGGREGATE LIABILITY TO A PILOT USER ARISING OUT OF OR RELATING TO THIS NO-COST PILOT WILL NOT EXCEED $1,000.
THESE LIMITATIONS DO NOT APPLY TO NEXAVERSE’S FRAUD, WILLFUL MISCONDUCT, OR GROSS NEGLIGENCE, OR TO OTHER LIABILITY THAT APPLICABLE LAW DOES NOT PERMIT TO BE LIMITED OR EXCLUDED.
These Terms do not require a family participant to indemnify Nexaverse as a condition of this limited no-cost pilot. Indemnification for commercial customers, organizations, or future paid services is addressed in separate agreements.
27. Governing Law and Good-Faith Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles, except where another law must apply. Before pursuing formal legal remedies, Nexaverse and the user should attempt in good faith to resolve a pilot-related disagreement through direct communication when reasonable. These Pilot Terms do not require arbitration and do not include a class-action waiver.
28. Changes to These Terms
Nexaverse may update these Terms as the pilot, product, technology, or law changes. Material changes affecting a user’s rights, privacy, permissions, existing content, or memorial access will be communicated appropriately. A later update does not silently rewrite the historical scope of a contributor’s recorded permission or specialized consent. Renewed acceptance may be required when a material change reasonably requires it.
29. Contact and Support
General questions: support@anthavi.com. Privacy and data requests: support@anthavi.com, with “Privacy request” in the subject line. Copyright and media concerns: app.anthavi.com/report or support@anthavi.com. Urgent privacy, safety, or family-authority concerns: support@anthavi.com, with “Urgent” in the subject line. Funeral-home workflow questions: the designated funeral director.
30. Electronic Acceptance and Records
Anthavi may use clickwrap, electronic acknowledgment, or electronic signatures for pilot acceptance. Nexaverse may record participant identity, role, case ID, applicable Terms/policy versions, timestamp, acceptance result, Living Story selection/visibility, Tribute review/approval when applicable, specialized-consent states, and later material changes. Participants will receive or have a durable way to retrieve the version they accepted.
31. Relationship to Other Pilot Documents
These Terms work with the Pilot Privacy Policy, Contribution Guidelines & Acceptable Use, Contributor Acknowledgment, Family Pilot Consent & Authorization, User Content/Copyright & Media Policy, Funeral Home Authorized User Acknowledgment, separate specialized consents, and any applicable signed funeral-home pilot agreement. A more specific document controls on the same subject to the extent it provides a narrower or more specific rule.
